Welcome to Kshudhanshu Developers. These Terms and Conditions govern your use of our website, services, and products. By accessing or using our services, you agree to be bound by these terms. If you do not agree to any part of these terms, you may not use our services.
1. Service Agreement
1.1 License Grant: We grant you a limited, non-exclusive, non-transferable license to use our services in accordance with these terms.
1.2 Restrictions: You may not:
- Copy, modify, or create derivative works
- Reverse engineer or decompile our software
- Use our services for illegal purposes
- Interfere with or disrupt service operations
- Attempt to gain unauthorized access
2. Payment & Billing
2.1 Fees: You agree to pay all fees according to the pricing plan selected.
2.2 Billing Cycle: Payments are billed monthly, quarterly, or annually based on your subscription.
2.3 Invoice Payment: All invoices are due within 30 days unless otherwise specified.
2.4 Late Payment: Late payments may incur a 1.5% monthly interest charge and service suspension.
3. Cancellation & Refunds
3.1 Cancellation Policy: You may cancel your subscription at any time with 30 days written notice.
3.2 Refunds: Refunds are issued for unused prepaid services within 30 days of cancellation.
3.3 Data Retention: Upon cancellation, we retain your data for 90 days before permanent deletion.
4. Service Level Agreement (SLA)
4.1 Uptime Guarantee: We guarantee 99.9% uptime availability.
4.2 Maintenance Windows: Scheduled maintenance occurs on Sundays 2-4 AM IST.
4.3 Support Response Times:
- Critical issues: 1 hour
- High priority: 4 hours
- Medium priority: 24 hours
- Low priority: 48 hours
5. Intellectual Property
5.1 Our IP: All software, designs, and documentation are our intellectual property.
5.2 Your IP: You retain ownership of your data and content uploaded to our services.
5.3 White-Label Rights: For white-label solutions, you own the customer-facing branding while we retain backend IP.
6. Disclaimers & Limitations
6.1 As-Is Basis: Services are provided "as is" without warranties of any kind.
6.2 Liability Cap: Our liability is limited to the total fees paid in the 12 months preceding the claim.
6.3 Exclusions: We are not liable for indirect, incidental, or consequential damages.
7. Data Protection
7.1 GDPR Compliance: We comply with GDPR and other data protection regulations.
7.2 Data Processing Agreement: Available upon request.
7.3 Encryption: All data is encrypted in transit and at rest.
8. Termination
8.1 Termination by You: You may terminate at any time with 30 days notice.
8.2 Termination by Us: We may terminate for breach of terms or non-payment after 15 days notice.
8.3 Effect of Termination: Upon termination, your access ceases immediately.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Pune, India.
